Represented various general contractors in litigation / arbitration with project owners over delay, changed conditions and design issues for sanitary landfills, water treatment facilities and other public and commercial buildings. -
Represented hundreds of homeowners in claims against homebuilders, remodelers, design professionals, subcontractors and material suppliers involving negligent construction of homes valued from mid six figures to low seven figures. Claims involved defectively designed and installed windows, negligent construction of stucco and masonry exteriors, and problems related to water infiltration and mold. -
Represented owner and completing lender for $100 million multi-use project in claims against numerous contractors and architect for negligent design and construction. Included litigation with glazing contractor and surety over defectively designed, fabricated and installed skylight and window system plus litigation with roofing contractor regarding defective roof construction. -
Represented completing surety with respect to completion of multiple public building projects left unfinished by defaulting general contractor. Involved negotiation and drafting of takeover and completion agreements, assignments of subcontracts, negotiation and settlement of payment bond claims, and the pursuit of claims against owners, design professionals, subcontractors and indemnitors. -
Represented general contractor in claim against defaulting subcontractor’s performance bond surety to recover excess costs to complete project. -
Represented HVAC subcontractor on seven figure claim against prime mechanical contractor for delays, disruption and acceleration on public building project. -
Represented prime asbestos abatement contractor in seven figure claim against school district for additional compensation due to unforeseen conditions encountered during asbestos abatement in public school. -
Represented general contractor in defense of multi million dollar claims of defective construction of large apartment complex. -
Represented numerous utility, highway and bridge contractors in claims (as high as low seven figures) against the State of Minnesota and various county and municipal entities for differing site conditions, delays and disruption. -
Represented national construction trade association in filing amicus brief on appeal of trial court decision involving application and interpretation of the statute of limitations set forth in Minn. Stat. §541.051. -
Represented general grading, utility and street contractor in mechanics’ lien foreclosure lawsuit against developer, including jury trial to verdict and appellate representation up to the Minnesota Supreme Court. -
Represented multinational company in defense of claims by contractors for additional compensation and in assertion of claims against contractors for defective work in connection with remediation of Superfund site in Minnesota. -
