Many of the standard form construction contracts now being used allow for the designation upfront of a neutral third-party to assist the parties in resolving disputes that may arise on a construction project. These proceedings can be non-binding, similar to mediation or a moderated settlement conference, or, at the election of the parties, can result in a binding determination by the neutral, similar to an arbitration process.
